This website is operated by Especially Paper. Throughout the site, the terms "we," "us," and "our" refer to Especially Paper. By visiting our site or making a purchase, you agree to these Terms of Service ("Terms"), along with any other policies referenced here (like our Privacy Policy and Refund Policy).

Please read these Terms carefully. If you don't agree with any part of them, please don't use the site.

We may update these Terms from time to time. The current version is always on this page, and the "last updated" date at the bottom shows when it was last changed. Your continued use of the site after we post changes means you accept the updated Terms.

Our store is hosted on Shopify, which provides the e-commerce platform we use to sell our products.

1. Eligibility

By using our site, you confirm that you're at least 18 years old (or the age of majority where you live, if older) and able to enter into a binding agreement. If you're using the site on behalf of a minor in your household, you're responsible for their activity.

You may not use our products or the site for any illegal purpose, and you may not transmit any viruses or malicious code. We may terminate your access if you violate these Terms.

2. Products and Digital Goods

Digital products. Especially Paper sells digital goods (such as downloadable files, templates, and printables). When you buy a digital product, we grant you a limited, non-exclusive, non-transferable license to use it for your own personal use. Unless we explicitly say otherwise on the product page, you may not:

Resell, redistribute, or share the file with others
Claim the design as your own
Use it for commercial production
Modify and resell the file as your own product

Specific usage rights for each product are listed on the product page. If you're unsure how you're allowed to use something, contact us before you buy.

Delivery. Digital products are delivered electronically via a download link sent by email or available in your account immediately after purchase. We're not responsible for delivery delays caused by your email provider or spam filters. If you don't receive your download within a reasonable time, contact us and we'll resend it.

Refunds. Because digital products are delivered immediately and can't be returned, all sales of digital products are final and non-refundable once the file has been delivered or downloaded. If there's a problem with the file itself (corrupted, missing pages, wrong file), contact us within 7 days and we'll fix it or refund you. By completing your purchase, you acknowledge and accept this refund policy.

Product accuracy. We do our best to display products accurately, including colors and previews. We can't guarantee your screen shows colors exactly as they'll print, and small differences between the preview and the final file may occur.

3. Pricing and Orders

Prices may change without notice. We reserve the right to refuse or cancel any order, limit quantities, or correct pricing errors — including after an order has been placed. If we cancel your order, we'll refund any payment you've made.

You agree to provide accurate billing and account information and to keep it updated.

We may modify or discontinue any product or part of the Service at any time, and we won't be liable to you or any third party for those changes.

4. Text Message (SMS) Marketing

If you opt in to receive text messages from Especially Paper, you agree to receive recurring automated marketing and informational messages at the phone number you provide. Consent isn't required to make a purchase. Message frequency varies, and message and data rates may apply.

You can opt out anytime by replying STOP to any message, or get help by replying HELP. Full SMS terms are covered in our Privacy Policy.

5. Accounts and Account Security

If you create an account, you're responsible for keeping your login credentials secure and for all activity that happens under your account. Let us know right away if you suspect unauthorized access.

6. User Content and Submissions

If you send us comments, suggestions, ideas, or other content ("Submissions"), you grant us permission to use them in connection with our business without compensation or obligation to keep them confidential. We're not obligated to respond to or act on Submissions.

You're responsible for the content you submit. Submissions must not violate anyone's rights (including copyright, trademark, or privacy), must not be unlawful, abusive, defamatory, or obscene, and must not contain viruses or malware.

We may, but aren't required to, remove content we consider inappropriate.

7. Prohibited Uses

You may not use the site or its content to:

Do anything unlawful, or encourage others to
Violate any law, regulation, or ordinance
Infringe our or anyone else's intellectual property rights
Harass, abuse, or discriminate against others
Submit false or misleading information
Upload viruses or malicious code
Collect or track other users' personal information
Spam, phish, scrape, or interfere with the site's security

We may terminate your access if you violate these rules.

8. Intellectual Property

All content on this site — including text, graphics, logos, images, designs, and digital products — is owned by Especially Paper or our licensors and is protected by copyright, trademark, and other intellectual property laws. Buying a digital product gives you the usage license described on the product page; it doesn't transfer ownership of the design itself.

9. Third-Party Links and Tools

Our site may link to or integrate with third-party websites, tools, or services. We don't control or endorse them and aren't responsible for their content, accuracy, or practices. Review their terms and policies before using them.

10. Errors and Inaccuracies

Occasionally there may be typos, inaccuracies, or missing information on the site related to product descriptions, pricing, or availability. We may correct errors and update information at any time, including after you've placed an order, without prior notice. We're not obligated to update information except as required by law.

11. Privacy

Your personal information is handled according to our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimer of Warranties

We provide the site and our products "as is" and "as available." We don't guarantee that the site will be uninterrupted, secure, or error-free, or that results from using our products will meet your expectations. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent allowed by law, Especially Paper and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or replacement costs — arising from your use of the site or our products, even if we've been advised of the possibility.

Our total liability to you for any claim related to the site or a product will not exceed the amount you paid us for the product giving rise to the claim. Some states don't allow these limitations, so they may not fully apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Especially Paper and its owners, employees, contractors, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or third-party right.

15. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights, including your right to bring a lawsuit in court or participate in a class action.

Informal resolution first. Before starting any formal dispute, you agree to contact us at info@especiallypaper.com and give us 60 days to try to resolve the issue informally. Most disputes can be settled this way.

Binding arbitration. If we can't resolve the dispute informally, you and Especially Paper agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site or our products will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in or near our principal place of business in Maryland, or by phone or video at your election. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring a claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights.

Class action waiver. You and Especially Paper agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

30-day opt-out right. You may opt out of this arbitration agreement by emailing info@especiallypaper.com within 30 days of your first purchase, with the subject line "Arbitration Opt-Out" and your full name. Opting out doesn't affect any other part of these Terms.

If any part of this Section 15 is found unenforceable, the rest stays in effect, except that if the class action waiver is found unenforceable, then this entire Section 15 will not apply.

16. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict of laws principles. Subject to Section 15, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.

17. Termination

These Terms remain in effect until terminated by either you or us. You may stop using the site at any time. We may terminate your access at any time if we believe you've violated these Terms. Sections that by their nature should survive termination (including liability limits, indemnification, and dispute resolution) will survive.

18. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with our Privacy Policy and any other policies posted on the site, are the entire agreement between you and Especially Paper regarding your use of the site, and supersede any prior agreements.

Our failure to enforce any part of these Terms isn't a waiver of our right to do so later.
